When discussing workplace injuries, the team here at Willis, Willis, & Rizzi likes to break things into two categories: workplace injuries where you are on the job and get injured and workplace injuries where the person who injures you is on the job, and you may or may not be on the job.

When discussing cases where you are on the job and get injured by someone else, the fact that you are working genreally entitles you to workers compensation. This program is available to you to cover medical expenses, a portion of lost wages, and can also provide disability benefits if there are lingering issues from your injuries.

An important consideration with workers compensation is that you have the right to come back in the future and re-open the claim if you need additional medical treatment or therapy for your injuries. This is the exact opposite of personal injury claims in the common law world. In common law personal injury claims when they come to their end and a settlement is reached, they are over. The responsible party is going to pay you money and you will sign a release saying, “it’s done”. There’s no coming back to make further claims if there is future medical treatment that is required. If we expect future medical care or therapy treatment, we must build that into a one-time settlement.

If you are on the job and injured by a fellow worker/employee of the company, then workers compensation is generally the only avenue you have to get compensation for your injuries. If you are injured by someone who is not a coworker working for your company, then you have an additional common law personal injury claim against that person or company who is responsible for your injuries.

Let’s use some examples:

You are working for ABC company driving down the road and you are hit and injured by a vehicle being driven by XYZ company. You have a workers compensation claim because you are on the job. However, you also have a claim against XYZ company and its driver for the injuries they caused you. 

If you are driving for personal reasons and you are not on the job and you are hit by XYZ company, you do not have a workers compensation claim since you were not on the job, but you do have a common law claim against the driver and XYZ company for your injuries. XYZ company is responsible for the actions of their driver while on the job, so you not only have a claim against the driver, but also the company that employs the driver.
