Concussion Injury Attorneys

Concussion is a generic term that you hear in the NFL (National Football League) or other contact sports. In the medical field, a concussion is a Traumatic Brain Injury (TBI) that is classified at the “mild” level, on a scale of mild, moderate, or severe. With a mild traumatic brain injury, aka concussion, the diagnosis has always been by the question “What are your symptoms?” followed by “Well, I think you have a concussion” – but there’s no way to know.

Insurance companies hate concussions and traumatic brain injuries, because a traumatic brain injury can be a serious, significant injury which means more money the insurance company may have to pay out in the claims process. So, insurance companies fight mild traumatic brain injuries or concussions because they are hard to prove. There hasn’t been a definitive test for a concussion.

Until now.

New Concussion Testing

There is now some new concussion testing that is coming into place. For years, we have had blood tests that look for certain protein markers to determine if you have had a heart attack. But up to this point we have not had a blood test to document if you have a concussion. But there is now, and it is coming into play and has been approved by the FDA (Food and Drug Administration). It’s a simple blood test which looks for certain proteins and bio markers in the blood stream that get released by the brain when it has had an injury.

At Willis, Willis & Rizzi we think that this new concussion testing is good news in a lot of ways for victims because it will help them get the care they need, quicker. From the legal side it will help us prove that there was a concussion where in the past there has been ambiguity if there was or wasn’t a concussion.

With this new concussion testing coming into place, with a simple blood test a determination can be made if there was a concussion, aka a mild traumatic brain injury, or even something more severe.
